• JA Ringrose General NCAT Member in the case of Rofail v Volkswagen Group Australia Pty Ltd & Anor on 4 March, 2020 in the Consumer and Commercial Division of NCAT commented as follows:

“The market value of the applicant’s vehicle has been assessed by Mr Kannen who has the qualifications to determine that value.

Applying these interpretations the Tribunal is satisfied that a market value as assessed by the applicant’s expert should be applied rather than a dealer’s trade in figure which would invariably be a lesser amount enabling a dealer to sell the vehicle on the marketplace at a profit”.

• S Sutherland, Member of NCAT commented as follows in the case of Trevor Edmonds v Cleanairflow Solutions Pty Ltd: 

…..”on the other hand Mr Kannen is an experienced valuer and has provided reports to Courts and to NCAT and has extensive experience in valuations. I accept the calculations of Mr Kannen for the depreciation of the caravan as reliable. He provided an additional report on how he calculated the “reasonable service life” or “life span” of the caravan and that the number of caravan’s over 35 years are listed 3.5% of the caravans advertised on www.caravancampingsales.com.au.
